Terms of Services for the Talent part of ANYWR portal

Personal data protection policy

The COOPTALIS GROUP's mission is to support active people in their professional development.
Users use ANYWR applications and services to find professional opportunities throughout their career.

The COOPTALIS GROUP is concerned about the protection and confidentiality of personal data and is committed to ensuring the highest level of protection for your personal data in accordance with the regulations in force on the protection of personal data, applicable to all European citizens, and for companies whose registered office is in Europe (RGPD).

The purpose of this privacy policy is to inform you of the practical measures and commitments taken by COOPTALIS GROUP to ensure that your personal data is respected and protected when using our services.

It applies to all services (web applications, mobile applications, matchmaking services, targeting solutions for recommending job offers, application management solutions, etc. ) published and provided by GROUPE COOPTALIS from the various Sites and Applications.
It concerns all visitors to our Sites and users of our Services ("Users").

The terms "we", "us" and "our" refer to COOPTALIS GROUP and the Services we provide.

The terms "you" and "your" refer to all Users of our Services or visitors to our Sites or Applications. The term "Customer" refers to our business customers, i.e. legal entities. For further details on the definitions of capitalised terms, you can refer to our current TOS.


1 - Identity of the data controller

COOPTALIS GROUP collects and processes the personal data of its Users via its Sites, Applications or Solutions in order to provide you and our Clients with our Services.

In most cases, COOPTALIS GROUP acts as a controller or co-controller within the meaning of the General Regulation on personal data.

Its clients (recruiters or legal entities) act as co-controllers in the processing of applications.

2 - Purpose of processing and legal basis

The processing carried out by the COOPTALIS GROUP is for explicit, legitimate and specific purposes.

 

Putting people in touch with each other

Our Services allow you to be put in contact with our Clients, i.e.: legal entities wishing to recruit/search individuals for assignments.

Depending on the Services and Applications you use, we use your data to suggest to you and others opportunities offered by our Clients (job offers, company presentations) and more generally information related to professional life.

 

Helping you find opportunities for your career

We also process your data, with your permission, to facilitate your search and manage your requests or opportunities for contact with our Clients and to provide you with career information and advice.

Recommendations for career opportunities

The processing of your data allows us to get to know you better, to recommend Services targeted to your needs or corresponding to previous requests to be put in contact with our Clients and thus to improve the efficiency of our Applications and Services to better satisfy you.

The website stores cookies on your computer. These cookies allow us to improve the website experience and provide more personalised services, both on this site and via other media.

Your personal information will not be tracked when you visit our site. However, in order to respect your preferences, we will need to use a small cookie so that we do not have to ask you again.

 

Offering an effective range of services

We also use your personal data to develop new services to better meet your needs. These services fall within the scope of the purpose of our personal data processing, namely to put you in contact with our Clients and to manage this contact in the context of career monitoring, support and professional development.

 

To better understand your expectations in terms of career follow-up and professional development

Your answers to our surveys, when you choose to answer them, allow us to collect quantitative or qualitative information in our field of activity with the aim of producing anonymised statistical elements on the employment market, training, career follow-up and professional life (developments, career paths), employability. We may also take into account your responses in order to improve the operation of our Applications and Sites.

 

Creation of new services

If we carry out further processing of your data for purposes other than those described in our privacy policy, we will inform you of this. These new purposes will be consistent with the purposes described here and if not, we will seek your consent.

No personal data about you is used for purposes other than those for which it was collected. No personal data about you is passed on to our Clients without your consent.

 

3 - Data collected

GROUPE COOPTALIS ensures that it only processes personal data that is strictly necessary for the purposes detailed above (principle of proportionality of collection). In addition to the information necessary to establish a relationship (such as your first and last name, email address, etc.), only information relating to your expertise, skills or professional prospects or any specific features of your working conditions will be requested.

 

The data you provide to us

The data that we process are first of all the data that you provide to us via our application forms.
This includes your identification data, your contact data as well as data concerning your career path (experience, qualifications, skills, professional situation, remuneration), your professional prospects (your wishes in terms of remuneration, type of post or contract, training, your geographical preferences, etc.).

The compulsory nature of the data collected is indicated at the time of collection by a message. The data is only mandatory when it is necessary for us to process your request or when it is required by our Clients in order to respond to your request in a relevant manner.
If the mandatory data is not filled in, we will not be able to provide you with the Service you require.
Please note that our services are most effective when you regularly enter and update your career and development information.

We take care not to collect or pass on to our Clients any data that is not necessary for them to process your requests or to refine their selection of relevant profiles.

We also process data that you upload to our Sites and applications. This data is usually included on your CV. These uploads may include a photo or information about your specific working conditions.

When creating an account, we never ask for so-called sensitive information (racial or ethnic information, political opinions, religious or philosophical views, trade union membership, health, sexual orientation).


We advise you against providing such data when using our Services. However, if you choose to include so-called sensitive information in your CV or free texts, it will be transmitted, as is, under your sole responsibility and at your sole initiative, to our Clients with whom you wish to be put in contact.

Data on the use of our services

We also profile you based on your use and browsing of our Sites, Applications or Solutions.

This includes your IP address or connection devices used, your browsing data, cookie data (see Cookies section below), your match history, the industry in which you are interested, the messages we send you and the links you click, the courses you attend, the number of pages you view, the number of times you visit our Sites, and the activity of visitors on our Sites and the frequency with which they return (see Third Party Data section below).

 

Third party data

We receive personal data about you when you use the Services from our clients and partners, such as potential employers or applicant tracking systems, who provide us with data about the advertisements you apply for.

Our goal is to better understand how our Sites and applications are used and to measure our audience and the effectiveness of our Services so that we can tailor them to your needs.

We do not collect any third party data that you may write or post on third party partner sites. We also do not collect comments that third parties may make about you on partner platforms.

 

4 - Recipients of the data collected

Your personal data is only used by identified and authorised persons in view of the purposes described in this personal data protection policy.

COOPTALIS GROUP undertakes never to transmit your personal data to third parties for reasons unrelated to these purposes.

Thus, your data is only transmitted to the categories of persons listed below:

  • Our Clients if and only if you have given your prior consent (application for a job offer, making your CV available in our CV library, creating an account on our talent portal or our mobile application, etc.) and this, strictly within the framework of the purpose pursued.
  • Authorised services of GROUPE COOPTALIS (technical implementation team, customer relationship management team, recruiters, sales staff)
  • Our technical service providers: hosting, unformatted data extraction service, emailing service, auditing and IT security service provider



5 - Communication

Depending on the Services used or your preferences, we will contact you by email, postings on our Sites or Applications, SMS, instant messaging, push notifications or any other means of communication you provide.

 

6 - Security of collected data

All data collected is processed in such a way as to ensure appropriate security, which is reflected in a logical and physical security policy and security measures specifically adapted to our activities. Various audits are carried out within our infrastructures.

The COOPTALIS GROUP's
technical teams are aware of the RGPD and the protection of personal data is taken into account throughout the design and operation of applications.
Thus, the following principles govern the development of sites and applications, both in terms of technical infrastructure (secure redundant hosting, security and access control policy) and from the application point of view (development of sites and applications):

7 - Data retention

Your data will be stored for a maximum of one year2 from the last date of interaction with our services.
The data is then anonymised and can be used for statistical purposes.

 

8 - Your rights

In accordance with the regulations, you have the right to access, rectify, delete, oppose and port all data concerning you.
You also have the right to limit the processing of your personal data. Everyone also has the right not to be subject to individual decision-making based exclusively on automated processing such as profiling. If you have consented to the processing of personal data, you may withdraw your consent at any time.

11 - Update of the data protection policy

Terms and conditions of use of the site

Article 1 - Definitions

The "User": any natural or legal person using the Site. Automated systems or software accessing the Site are expressly considered as non-legitimate users of the database available on the Site or not having lawful access to the database available on the Site.

The "Candidate User": any User, a non-professional individual, who has registered.

The "Client": any User, natural person or legal entity acting within the framework of its professional activity, who has registered and subscribed to the paid or free services of the COOPTALIS GROUP.

The "Curriculum Vitae" or "CV": a note drawn up by the Candidate User detailing, in particular, his or her professional background, training and personal interests.

The "CVthèque": web space hosting CVs and Profiles and accessible via the Site to Clients who have subscribed to the "CVthèque" service.

The "Personal Space": a space dedicated to each User who has registered and accessible by means of a password. Following Registration, the Candidate User automatically receives an e-mail proposing the creation of a password associated with the e-mail address provided. The Candidate User will then be able to modify and/or complete his/her personal information.

Registration": action enabling a User to access certain Services, and materialised by the communication of his/her email address to GROUPE COOPTALIS.

The "Content": it is about offers of internships, jobs, training, skills assessment, franchising, wage portage, creation and takeover of companies, personalised support, coaching, invitations to tender, retraining, services related to professional life; information on Clients and companies in general, on career and career management, on setting up and taking over a company, on franchising, on law, on professional reconversion, on training, on skills assessment, on wage portage, on personalised support, on coaching, and more generally on the theme of professional life.

The company "GROUPE COOPTALIS": SAS COOPTALIS, located at 992 bis avenue de la République, 59700 Marcq en Baroeul, registered under SIRET number 753 670 306 00053.

The "Services": all the services offered by GROUPE COOPTALIS, available on the Site and listed below.

The "Notification": message proposing the Content to the Users by all communication channels and notably the following means: banner and graphic element on the Site, e-mail, SMS, mobile notification, web notification.

The "Profile": all the data collected and recorded by COOPTALIS GROUP about a User. For a Candidate User, the Profile is nominative. Otherwise, it is anonymous. The Profile includes the "Curriculum Vitae" when the Candidate User has used it on the Site.

The " Site ": the website accessible via the following domain names: cooptalis.com as well as all sub-domains.

Article 2 - Purpose

The purpose of these General Conditions is to set out the conditions of access and use of the Services offered on the Site.

Article 3 - Description of the Services

In the event of a change in the free-of-charge nature of the Services offered on the Site, the User Candidate and/or the Client will be informed as soon as possible by e-mail and will be free to subscribe or not to these new Services and/or to cancel his or her Registration to the modified Services.

3.1 Free services available to any User

All Users will have access to the following Services:

  • Searching, accessing and viewing Content
  • Customisation of Content according to Profile

3.2 Free services available to Candidate Users

  • Putting Clients in touch with each other directly or through GROUPE COOPTALIS
  • Customisation of Content according to Profile
  • Content Notification
  • The provision to Clients :
    • the Profile anonymously or by name with the prior consent of the candidate User
    • of the CV

The Candidate User is expressly informed that, as part of his or her Registration, all the Services offered by GROUPE COOPTALIS will be accessible to him or her, regardless of the domain name of the Site from which he or she has registered.

On the other hand, it is possible, at any time, and on simple request, to terminate its Registration to one or other or all of the Services.

3.3 Paid services available to the Customer

  • Gradual access to CVthèque

It is understood that the subscription to these Services implies the prior and unreserved acceptance of the GROUPE COOPTALIS General Terms and Conditions of Sale by the Client.

Article 4 - Conditions of access to the Site

By accessing the Site, the User acknowledges having read, understood and accepted these General Conditions and legal information. Consequently, the User acknowledges that any access to the Site binds him/her contractually to GROUPE COOPTALIS under the terms of these Terms and Conditions.

The User must ensure the compatibility of his or her computer hardware and software installed to access the Site. Access to the Services available to him is for an indefinite period, unless the Site is modified by COOPTALIS GROUP.

Article 5 - Registration - Personal area

5.1 When the User registers, the COOPTALIS GROUP creates a personal space that the User can set up using his or her identifier - e-mail address - and the password that he or she chooses on receipt of the e-mail from the COOPTALIS GROUP.

The User is solely responsible for maintaining the confidentiality of his/her login and password. The User is fully responsible for any act involving the use of his/her login and password. In the event of loss or theft of the login and/or password, or in the event of use by an unauthorised third party, the Candidate User or the Client must immediately contact the Site at the following address support@cooptalis.com

5.2 By registering, the Candidate User subscribes by default to all the Services referred to in Article 3.2 of these "Free services available to Candidate Users", and consequently agrees to receive all the notifications referred to in Article 3.2.

The Candidate User may, at any time, modify the parameters of his Personal Space to adapt the Services to his needs.

5.3 The closure of the Personal Space entails the termination of all Services.

Article 6 - Obligations of the User

The User may not use the Site's Services to engage in activities prohibited by law or good morals.

In general, the Site may only be used directly or indirectly for commercial purposes by COOPTALIS GROUP. The theme of the Site is professional life. The Site may not be misused by anyone for purposes unrelated to those above.

When registering, the Candidate User or the Client undertakes to indicate or disseminate, in any form whatsoever, only information or content that is true to life and relates to them personally. The Candidate User or the Client may not publish personal information about third parties without their express prior consent. In any event, GROUPE COOPTALIS may not be held liable in this respect.

The Candidate User or the Client is the sole judge of the information he/she wishes to put on the Site. They must not usurp the identity of a third party, nor publish messages that are defamatory or offensive, contrary to good morals or of a criminal nature.

By subscribing and publishing information about him/her, the Candidate User or the Client gives permission to GROUPE COOPTALIS, on the Site or via partners, to reproduce, represent and adapt the information concerning him/her and, in particular, to integrate these elements into the various pages and sections of the Site and/or the media of its partners.

Article 7 - Reporting

GROUPE COOPTALIS provides, free of charge or for a fee, the storage of content published by Candidate Users or the Client to make it available to Users.

Each User is invited to bring to the attention of COOPTALIS GROUP any content likely to be litigious, under the following conditions of form and content:

  • Mandatory notificationThe
    User must notify COOPTALIS GROUP, at support@cooptalis.com, of any message that is an apology for crimes against humanity, incites racial hatred, touches on child pornography, incites violence or offends human dignity.
  • Content likely to be unlawfulThe
    User who considers that a message or content on the Site is likely to be inaccurate or even unlawful, or of an abusive, discriminatory or defamatory nature, is invited to submit a notification.

Notification shall take the form of an e-mail sent to the address support@cooptalis.com or by registered letter with acknowledgement of receipt in which the User shall indicate his surname, first names (for a legal entity, its company name and registration number) and address.

The notification must include a description of the contentious facts and their precise location on the Site, the reasons why the content must be removed, including the mention of legal provisions and justifications of facts. If possible, the User should send a copy of the correspondence addressed to the author of the litigious information or activities requesting their interruption, withdrawal or modification, or the justification of the fact that the author or publisher could not be contacted.

The attention of the User making a notification is drawn to the fact that an inaccurate denunciation is likely to expose him/her to penal sanctions and agrees to guarantee the Site against the possible consequences of an abusive notification.

COOPTALIS GROUP undertakes to react promptly to any notification from a User that is made in the correct manner and is clearly well-founded or reveals facts that clearly constitute a violation of a rule of law. The COOPTALIS GROUP will take care to preserve the anonymity of the author of the disputed comments, where appropriate, while reserving the right to take any useful measure against him/her, starting with his/her exclusion from the Site.

Article 8 - Distinctive elements of the Site - Intellectual property

8.1 The graphic charter of the Site, as well as all trademarks, logos, contributions, photographs, data, texts, comments, illustrations, animated or non-animated images, video sequences, sounds, patents, private data, technologies, products, publications, processes as well as all computer applications that may be used to operate the Site and more generally all elements reproduced or used on the Site are protected as intellectual property by the laws in force.

They are the full and complete property of COOPTALIS GROUP or its partners. Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of GROUPE COOPTALIS or the holder of the rights, is strictly prohibited, with the exception of downloading, displaying and printing the data on this site for exclusively private and non-commercial purposes.

8.2 The User may only use the Site for the purpose of accessing the Services, exclusively for private and non-commercial purposes.

In particular, the User expressly acknowledges and accepts that the use of automated systems or software to extract data from the Site, in particular the Content and the CV library ("screen scraping" / "web scraping" in particular), for any purpose whatsoever, whether commercial or not, is strictly prohibited, unless GROUPE COOPTALIS has entered into a written licence agreement expressly authorising the User to extract part of the data from the Site.

8.3 In the event that the Site's database is protected by Articles L. 342-1 et seq. of the French Intellectual Property Code (protection under sui generis law), any User is in any case prohibited from

  • to extract by permanent or temporary transfer all or a qualitatively or quantitatively substantial part of the content of the CV Database and/or the Content accessible on the Site onto another medium, by any means and in any form whatsoever;
  • to reuse, by making available to the public, all or a qualitatively or quantitatively substantial part of the content of the CV Database and/or the Content, in whatever form;
  • repeatedly or systematically extracting or reusing qualitatively or quantitatively insubstantial parts of the content of the CV Database and/or the Content when these operations clearly exceed the normal conditions of use of the Site's database;
  • to commercially exploit the rights of access to or publication of the Content with third parties, or the Content itself.

8.4 COOPTALIS GROUP reserves the right to terminate these terms and conditions by operation of law and to take any action to sanction any infringement of its intellectual property rights.

Article 9 - Liability

For all the obligations incumbent on it, COOPTALIS GROUP is bound by an obligation of means and not of result.

  1. a) Access and operation of the Site

The Site relies on technologies developed by third parties. The Site undertakes to implement all necessary means to ensure continuous access to the Site. However, in order to ensure the technical maintenance of the Site, access may be interrupted from time to time. As far as possible, COOPTALIS GROUP will endeavour to inform Users of this via the Site.

GROUPE COOPTALIS declines all responsibility in the event of any prejudice that may result from the unavailability of the Site or from a problem connecting to the Site.

The COOPTALIS GROUP may not be held liable, without this list being exhaustive, for the loss of profits, customers, data or information stored on the Site in the context of professional or commercial use, nor for indirect damage in the context of personal use.

  1. b) Content and CV published on the Site

The information provided on the Site, including the interpretation of regulations and practices, is for information purposes only. For personalised advice or to find a legislative, regulatory or contractual text, the User should refer to the official information of the public services concerned.

The dissemination of Content published by a Client, on the Site or by a Notification, does not mean that this Content is recommended by COOPTALIS GROUP. Consequently, COOPTALIS GROUP cannot be held responsible for Content containing false or incomplete allegations or which may be misleading.

COOPTALIS GROUP cannot be held responsible for false statements made by Clients and Candidate Users. Similarly, COOPTALIS GROUP cannot be held responsible if the information communicated by these Candidate Users and Clients on the day of their Registration or the publication of the message concerned has become obsolete.

The information and contributions published on the Site are therefore the sole responsibility of the Candidate Users and Clients.

The Candidate User and the Client also acknowledge that COOPTALIS GROUP cannot be held responsible for the relationship that may develop between the Candidate User and the Client as a result of using the Services.

The liability of COOPTALIS GROUP will only be incurred if it is established that the damage reported results from its own fault and provided that there is a direct and certain causal link between the alleged fault and the damage suffered by the User.

COOPTALIS GROUP cannot be held responsible for the loss or destruction of the Content and/or CV.

The COOPTALIS GROUP shall not be liable for any breach of these conditions of access and use of the Site by a User.

In any event, the liability of GROUPE COOPTALIS or any other future operator shall not exceed €150, for all types of damage.

Article 10 - Statute of limitations

Any liability action against GROUPE COOPTALIS is time-barred one year after the occurrence of the damaging event.

Article 11 - Data processing and liberties - Personal data

11.1 The Site implements a system for collecting and processing personal data exchanged when a User accesses the Site.

11.2 COOPTALIS GROUP collects personal data in the following ways:

  1. a) Data communicated by the Candidate User or the Client to COOPTALIS GROUP

This data is collected to enable the Candidate User or the Client to access all the functionalities of the Services to which he/she has voluntarily subscribed when registering and listed in articles 3.2 and 3.3.

This is usually the email address, surname, first name, etc.

The User is systematically informed of the compulsory or optional nature of the data requested, to enable him/her to access the Services.

The provision of optional data is intended to enable COOPTALIS GROUP to provide optimised Services, with a view to satisfying the User's needs and profile as far as possible.

  1. b) Information collected at each visit of the User to the Site

This non-personal information does not allow COOPTALIS GROUP to identify the User personally until it is linked to a Candidate User's Profile.

These are :

  • IP address ;
  • The data collected through the use of cookies. In this respect, GROUPE COOPTALIS refers the User to its policy on the use of cookies, which is accessible on the Site;
  • The unique identifiers of the User's terminal;
  • The criteria of the Content consulted by the User (such as: profession, skill, sector, locality, type of contract, remuneration, level of qualification, company name, function);
  • The date of consultation of the Content.

The purpose of collecting and processing this data is to provide the Services listed in Article 3.1 and 3.2 for an Applicant User, and in Article 3.1 for any User.

11.3 Any personal data concerning the User is collected directly on the Site. The User has the right to oppose, access, rectify and delete personal data concerning him/her. To exercise these rights, the User must send an e-mail to the Site at dpo@cooptlais.com.

11.4 Cooptalis Group transfers the Applicant's personal data to the Client to whom the Applicant has applied. Cooptalis Group draws the Applicants' attention to the need to consult and accept (when required) the Client's provisions relating to personal data before validating their application. Cooptalis Group is not responsible for the processing of personal data that is subsequently carried out by the Client in its capacity as data controller.

11.5 By accepting our T&Cs, you agree to our Privacy Policy describing the treatment of your personal data.

Article 12 - Severability - Interpretation

The fact that the COOPTALIS GROUP or the User does not exercise, at any time, any of the prerogatives recognised in these General Conditions may not be interpreted as an express or tacit waiver of the right to exercise said prerogative in the future.

Furthermore, the recognition of the invalidity of a clause will not affect the validity of the rest of the General Conditions and of any other clause.

Article 13 - Applicable law - Competent court

The present conditions, the appendices and any document taken in application are subject to French law. Any dispute concerning the interpretation and execution of these conditions shall be brought before the courts of common law in the case of a non-professional User and before the courts of LILLE, notwithstanding multiple defendants or the introduction of third parties, in the case of professional Users.
